Artificial Intelligence (AI) is no longer a science fiction fantasy: it is a reality! But while this technology is advancing rapidly, Latin America is racing to catch up with the legislation that regulates it.
The problem? The pace of laws does not always keep pace with innovation.
Eight countries in the region, including Mexico, Argentina, Colombia, Costa Rica, Chile, Ecuador, Panama and Peru, are working on AI-related projects. However, most are focused on regulating risks, and only a small portion of the initiatives seek to promote its development. Chile, for example, stands out with a project presented in May 2024, which classifies AI into four categories according to their level of risk, which could be a key step towards clear and effective regulation.
According to a report by the Economic Commission for Latin America and the Caribbean (ECLAC), the gap between Latin America and powers such as the United States and China is enormous.
In 2023, the region allocated only US$ 11.59 billion to AI, while the US invested US$ 87.18 billion. Moreover, in Latin America, AI penetration is less than 4%, in contrast to Europe, where it exceeds 20%. This gap highlights the urgent need to boost investment and the training of local talent.
Although more than half of the legislative projects seek to regulate AI risks, few focus on fostering training or incentives for investment. Without a comprehensive approach, Latin America risks falling behind, not only in technology, but also in economic competitiveness.
To take advantage of the full potential of AI, governments must include the development of this technology in their public agendas. In addition, as Gabriela Arriagada, an academic at the UC Institute of Applied Ethics, points out, digital literacy is key for society to understand and manage this technology in an ethical manner. AI regulation must balance risk mitigation with the promotion of innovation.
